RELIEF OF IMPORT DUTY ON THE IMPORT OF BUSES IN A COMPLETELY BUILT UP
(CBU) CONDITION FOR THE NEED OF PUBLIC TRANSPORT

THE MINISTER OF FINANCE,

Considering:

• a. that in the framework of fulfilling the urgent need for public transport facilities, it is deemed necessary to give relief of import duty on the import of 300 (three hundred) buses in a Completely Built Up (CBU) condition;
• b. that based on the consideration as meant in letter a, it is necessary to stipulate a regulation of the Minister of Finance on Relief of Import Duty on the import of Buses in a Completely Built Up (CBU) Condition;

In view of:

• 1. Law No. 10/1995 on Customs Affairs (Statute Book of 1995 No. 75, Supplement of Statute Book No. 3612);
• 2. Presidential Decree No. 187/M/2005;
• 3. Decree of the Minister of Finance No. 545/KMK.01/2003 on Stipulation of System of Classification of Imported Goods;
• 4. Decree of the Minister of Finance No. 547/KMK.01/2003 on Stipulation of Tariffs of Import Duty on Imported Goods;

DECIDES:

To stipulate :

THE REGULATION OF THE MINISTER OF FINANCE ON RELIEF OF IMPORT DUTY ON THE IMPORT OF BUSES IN A COMPLETELY BUILT UP (CBU) CONDITION FOR THE NEED OF PUBLIC TRANSPORT

Article 1

(1) The import of 300 (three hundred) buses in a Completely Built Up (CBU) condition (HS Ex No. 8702.10.26.00, 8702.10.27.00, 8702.10.28.00, 8702.10.31.00, 8702.10.32.00, 8702.10.56.00, 8702.10.57.00, 8702.10.58.00, 8702.10.59.00 and 8702.10.60.00) for the need of public transport shall be given relief of import duty so that the final tariff of import duty becomes 5% (five percent).

(2) The Minister of Transportation shall stipulate the public transport companies and allocation of the imported buses as meant in paragraph (1).

Article 2

Applications for obtaining the relief of import duty as meant in Article 1 paragraph (1) shall be submitted by the public transport companies as meant in Article 1 paragraph (2) to the Director General of Customs and Excise with a copy made available to the Director General of Land Transportation and the Director General of Foreign Trade.

Article 3

The Director General of Customs and Excise on behalf of the Minister of Finance shall issue a decree of the Minister of Finance on the granting of relief of import duty as meant in Article 1.

Article 4

The Director General of Customs and Excise shall regulate further the implementation of the provisions in this regulation.

Article 5

The regulation shall come into force for 12 (twelve) months, starting from March 10,2006.

For public cognizance, the regulation shall be published by placing it in State Gazette of the Republic of Indonesia.
